Please read these Terms of Use carefully before accessing or using the Alutvrek platform. By creating an account, accessing any content, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use our services.
1. Definitions
The following terms apply throughout this document:
- Platform refers to the Alutvrek website, applications, tools, and all associated services available at ryjulya.com.
- User means any individual who accesses, browses, registers on, or otherwise interacts with the Platform.
- Account means the registered profile created by a User to access personalised features of the Platform.
- Content means all text, images, video, audio, quizzes, assessments, interactive materials, and any other information made available through the Platform.
- User Content means any material submitted, uploaded, or otherwise contributed to the Platform by a User.
- We, Us, Our refers to Alutvrek, operated from New Clock House, Cork, P51 C820, Ireland.
2. Eligibility
Use of the Platform is permitted only to individuals who are capable of forming a legally binding agreement. By using the Platform, you represent and warrant that:
- You are at least 16 years of age, or have obtained verifiable parental or guardian consent if required under applicable law in your jurisdiction.
- You have the legal capacity to enter into these Terms.
- You are not prohibited from using the Platform under any applicable law or regulation.
- All information you provide during registration and use of the Platform is accurate, current, and complete.
We reserve the right to suspend or terminate access for any User who does not meet these eligibility requirements.
3. Account Registration and Security
3.1 Creating an Account
Certain features of the Platform require you to register for an Account. When registering, you must provide truthful and complete information. You are responsible for keeping your account details up to date.
3.2 Account Credentials
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your password with any third party. Any activity conducted through your Account is your responsibility, whether or not you authorised it.
3.3 Unauthorised Access
If you become aware of any unauthorised use of your Account or any security breach, you must notify us immediately at support@ryjulya.com. We will not be liable for any loss resulting from unauthorised use of your Account that occurs before you notify us.
3.4 One Account Per User
Each User may maintain only one active Account. Creating multiple accounts to circumvent restrictions, bans, or platform limitations is strictly prohibited.
4. Permitted Use
The Platform is intended for personal, non-commercial educational use unless a separate written agreement expressly permits otherwise. You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of any third party.
Permitted activities include:
- Accessing and completing quizzes, tests, and learning materials made available to you.
- Tracking your own learning progress and results.
- Participating in community features in a respectful and constructive manner.
- Downloading materials where an explicit download option is provided.
5. Prohibited Conduct
The following actions are strictly prohibited when using the Platform:
- Reproducing, distributing, publicly displaying, or creating derivative works from any Platform Content without prior written authorisation.
- Using automated tools, bots, scrapers, or scripts to access, collect, or interact with the Platform.
- Attempting to gain unauthorised access to any part of the Platform, its servers, or connected systems.
- Uploading or transmitting malicious code, viruses, or any software intended to disrupt or damage the Platform.
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
- Engaging in any conduct that harasses, abuses, threatens, or intimidates other Users or staff.
- Submitting false, misleading, or fraudulent information through any part of the Platform.
- Circumventing any technical measures used to protect or restrict access to Content.
- Using the Platform to advertise, solicit, or promote third-party products or services without our express written consent.
- Selling, transferring, or sublicensing access to your Account or any Content to any third party.
Violation of any prohibition listed above may result in immediate suspension or permanent termination of your Account without notice or refund.
6. Intellectual Property
6.1 Ownership
All Content on the Platform, including but not limited to text, graphics, logos, quiz questions, assessments, course materials, software, and design elements, is the exclusive property of Alutvrek or its licensors and is protected by applicable intellectual property laws.
6.2 Limited Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal educational purposes.
6.3 Restrictions
This licence does not permit you to copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works from any part of the Platform or its Content, except as expressly authorised in writing by us.
6.4 Feedback
If you provide suggestions, ideas, or feedback regarding the Platform, you grant us a perpetual, irrevocable, royalty-free licence to use and incorporate that feedback without any obligation to you.
7. User Content
7.1 Your Responsibility
You retain ownership of any User Content you submit to the Platform. By submitting User Content, you represent that you have all necessary rights to do so and that your submission does not violate any third-party rights or applicable law.
7.2 Licence Grant
By submitting User Content, you grant Alutvrek a worldwide, non-exclusive, royalty-free licence to use, store, display, reproduce, and distribute that content as necessary to operate and improve the Platform.
7.3 Content Standards
User Content must not be unlawful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable. We reserve the right to remove any User Content that violates these standards at our sole discretion and without prior notice.
8. Third-Party Links and Services
The Platform may contain links to third-party websites or integrate with third-party services. These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website or service. Accessing third-party resources is done entirely at your own risk.
9. Payments and Subscriptions
9.1 Paid Features
Certain features of the Platform may be available only through a paid subscription or one-time purchase. All applicable fees will be clearly communicated prior to purchase.
9.2 Billing
By purchasing a subscription or paid feature, you authorise us or our payment processor to charge your selected payment method for the applicable fees. Recurring subscriptions will be billed automatically at the interval selected at the time of purchase unless cancelled.
9.3 Cancellation
You may cancel a subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period. Access to paid features remains available until the end of the paid period.
9.4 Refunds
Refund eligibility is determined on a case-by-case basis. To request a refund, contact us at support@ryjulya.com within 14 days of the original transaction. We reserve the right to decline refund requests where access to Content has been substantially used.
9.5 Price Changes
We reserve the right to modify pricing at any time. We will provide reasonable advance notice of any price changes affecting active subscriptions. Continued use of the Platform after a price change takes effect constitutes acceptance of the new pricing.
10. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the Platform will be uninterrupted, error-free, or free of harmful components.
- Any warranty regarding the accuracy, completeness, or reliability of any Content.
Educational content on the Platform is intended for general informational and learning purposes only and does not constitute professional advice of any kind.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Alutvrek and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of data, profits, goodwill, or business opportunities.
- Damages arising from unauthorised access to or alteration of your data.
- Any matter beyond our reasonable control.
Where liability cannot be fully excluded under applicable law, our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total fees paid by you to us in the twelve months preceding the claim, or (b) fifty euros (€50).
12. Indemnification
You agree to defend, indemnify, and hold harmless Alutvrek and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or access to the Platform.
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property rights.
- Any User Content you submit to the Platform.
13. Termination
13.1 Termination by You
You may close your Account at any time by contacting us at support@ryjulya.com or through the account management settings where available.
13.2 Termination by Us
We reserve the right to suspend or permanently terminate your Account and access to the Platform at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or harmful behaviour, or for any other reason that we consider appropriate to protect the integrity of the Platform or other Users.
13.3 Effect of Termination
Upon termination, your licence to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination - including intellectual property rights, disclaimers, limitations of liability, and indemnification - shall continue to apply.
14. Modifications to the Platform
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any feature thereof.
15. Changes to These Terms
We may update these Terms of Use from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Where changes are material, we will make reasonable efforts to notify registered Users, such as by displaying a notice on the Platform or sending an email to the address associated with your Account.
Your continued use of the Platform following the publication of updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Platform.
16. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. We encourage you to review it carefully.
17. Governing Terms and Dispute Resolution
These Terms represent the entire agreement between you and Alutvrek with respect to your use of the Platform and supersede all prior agreements, understandings, and representations.
If you have a dispute with us, we encourage you to contact us first at support@ryjulya.com so that we can attempt to resolve the matter informally. We are committed to addressing concerns in good faith and in a timely manner.
If informal resolution is not possible, disputes shall be resolved through binding arbitration or other dispute resolution mechanisms as appropriate, unless you have the right under applicable law to bring a claim in a court of competent jurisdiction.
18. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or other authority of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Alutvrek to be effective.
